According to Billboard, a lawsuit has been filed against members of the band, Poison. The lawsuit pertains to a number of songs released by the band, which were allegedly plagiarised from another band performing in Los Angeles during the 1980s.
The accusations against the band were officialy filed in Illinois Federal Court on Wednesday, and relates to hits including "Talk Dirty To Me," "I Won't Forget You," "Fallen Angel" and "Ride the Wind.
The plaintiffs in the case are members of band, Kid Rocker. Billy McCarthy and James Stonich played in the Chicago band during the 1980s and were popular on the Los Angeles club circuit. The band were signed to Atlantic Records during this time, and wrote material now claimed to have been ripped off by Poison.
The link between the bands comes in the form of Poison guitarist C.C. DeVille, who according to the plaintiffs, auditioned for Kid Rocker before he joined Poison. DeVille was shown master tapes, and even lent copies of the band's music during the audition process.
McCarthy and DeVille were then involved in another band after Kid Rocker split up. McCarthy claims that DeVille then used the material when he went on to join Poison. Now the band are allegedly infringing on the rights of the plaintiffs whenever they sell copies of the songs, or whenever they perform the songs live.
